| 有效性已经成为掣肘大学章程充分发挥治理功能的主
要因素。要增强大学章程的实效性，前提是要正确认知大学章
程有效性的涵义及评价标准。大学章程的有效性意味着合乎
国家体制要求的“合体性”、反映大学多元利益相关主体利益
诉求的“兼容性”、对各主体具备充分规制效力的“强效性”、
符应大学学术本位的“逻辑性”、促进大学持续发展的“有用
性”及具备可靠的支持与保障条件的“系统性”。这是评估大学
章程是否有效的六个基本维度，也是实现我国大学章程建设
治理价值的六个主要取向。
的发展，不仅展现了现代大学治理的历史演进过程，也反映了
大学治理内涵与外延发展的终极目标追求。同时，如果只追
求“善治”而不关照“善治生态”的构建，也会使“善治”缺乏
“延展性”和“生命力”。唯有构建良好的“善治生态”，“人
治”与“法治”在走向“善治”的过程中才能和谐共生，才能使
“人治”得到规范的指引与匡正，“法治”彰显德行的渗透与化
育。欲使大学治理形成“善治生态”，就需促使学校、政府和市
场等多元力量在推进大学治理结构建设和大学治理性格养成
的过程中形成良性的互动态势。 |

Discussion on the Six Essential Dimensions of Validity

| Our university statutes construction is questioned and criticized because its formalism.
Seeing from the reality, the validity has become the main obstacle to play the university statutes'
governing function. To enhance the validity of university statutes, the precondition is to cognize the
meaning and evaluation criterion of the validity correctly. The validity of university statutes means
conforming to the state system, meeting the interest demand of multiple stakeholders in university,
possessing sufficient regulation effectiveness to each subject, according with the university logic of
academic orientation, possessing the usefulness of promoting university’s sustainable development and
being equipped with reliable supporting conditions. These are six dimensions of judging the validity of
university statutes, also are six main orientations of realizing the governance value for university statutes
construction. |
